In the context of the online sale of our purifiers, Solable is required to process your personal data that is strictly necessary.

“Personal data” refers to information that allows you to be identified directly or indirectly.

The confidentiality of personal data is extremely important to Solable, which aims to be transparent about how your personal data is used.

This legal notice details the conditions under which Solable commits to respecting your rights regarding personal data in accordance with the applicable regulations on personal data, namely:

The EU Regulation 2016/679 of April 27, 2016 (GDPR) concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation),

Law No. 78-17 of January 6, 1978, as amended, relating to information technology, files, and freedoms, and Decree No. 2019-536 of May 29, 2019, implementing the aforementioned Law No. 78-17.

IDENTITY OF THE DATA CONTROLLER

The data controller is Solable, as a legal entity, represented by

SUBCONTRACTORS

Solable may use subcontractors. Solable guarantees that it verifies and requires these subcontractors to provide sufficient guarantees regarding the protection of personal data.

PURPOSE OF PROCESSING

At each collection of your personal data, we will inform you of the purpose of the relevant processing. Solable commits to collecting only the personal data that is strictly necessary for the purpose of the processing.

LEGAL BASIS FOR PROCESSING AND MANDATORY OR OPTIONAL NATURE OF COLLECTION

For each specific processing of personal data that we collect from you, we will indicate the legal basis for this processing (consent, contractual execution, legal obligation, performance of a task carried out in the public interest or in the exercise of public authority vested in Solable).

It will also be specified whether the collection of your personal data is mandatory or optional, as well as the possible consequences if you choose not to provide them.

If the processing is based on your consent, you may withdraw your consent at any time.

RECIPIENTS OF YOUR PERSONAL DATA

For each specific processing of personal data that Solable collects from you, Solable will inform you of the recipients of this data. These recipients may include Solable’s services and its subcontractors.

Solable’s subcontractors will have limited access to only the personal data strictly necessary for the execution of the relevant services and have a contractual obligation to use them in compliance with the applicable regulations regarding personal data.

Solable commits not to transmit your personal data to any third party, other than its subcontractors. Under no circumstances does Solable sell, transfer, or exchange your personal data to third parties for commercial purposes.

RETENTION PERIOD FOR PERSONAL DATA

The retention period for your personal data is strictly linked to the legal basis for processing (contractual, legal and regulatory, or other), the nature of the personal data concerned, and the purpose of the processing.

For each specific processing, Solable will inform you of the retention period.

At the end of the retention period strictly necessary for the aforementioned purpose or in the event of the exercise of your rights, Solable commits to destroying all your personal data within the limits and conditions provided for in respect of its legal obligations (see below “Your rights”).

SECURITY OF PERSONAL DATA

In the context of implementing its public policies, Solable places the highest importance on the security of your personal data. Solable commits to taking all necessary precautions and implements appropriate technical and organizational security measures to permanently ensure a level of protection suited to the risks of infringement of your privacy and your personal data against alterations, destruction, breaches, and unauthorized access.

Personal data is stored on hosting servers located in the European Union or in third countries whose level of security regarding the protection of personal data is in line with that offered in the European Union and the European Economic Area.

In accordance with the applicable regulations, Solable maintains a register of processing activities of personal data.

YOUR RIGHTS

Right of access:

You have the right to request information about the personal data we hold concerning you.

Right to data portability:

The right to portability applies to data processed automatically and collected on the basis of your prior consent or the execution of a contract.

This right to portability entitles you to:

Retrieve the personal data you have provided, in a structured, commonly used, and machine-readable format

Request that your personal data be transmitted directly to another organization. Please note that this right to transfer does not apply to processing necessary for the execution of a task carried out in the public interest or in the exercise of public authority vested in the data controller.

Right to rectification:

You have the right to request the rectification of your personal data if they are inaccurate, including to complete your incomplete personal data.

Right to erasure/right to be forgotten:

You have the right to request, at any time, the erasure of all your personal data processed by Solable in the following cases:

  • Your personal data is no longer necessary for the purposes for which it was collected;
  • You decide to withdraw your consent on which the processing is based and there is no other legal basis for the processing;
  • You object to the processing and there are no overriding legitimate grounds for the processing;
  • Your personal data has been processed unlawfully;
  • A legal obligation requires the erasure of your personal data.

However, these obligations do not apply to the extent that this data processing is necessary:

  • For the exercise of the right to freedom of expression and information;
  • To comply with a legal obligation to which the data controller is subject;
  • To perform a task carried out in the public interest or in the exercise of public authority vested in the data controller;
  • For reasons of public interest in the field of public health;
  • For archival purposes in the public interest, for scientific or historical research purposes, or for statistical purposes;
  • For the establishment, exercise, or defense of legal rights.

Right to object to the processing of your data:

You have the right to object at any time to the processing of your personal data unless Solable presents legitimate and compelling grounds for the processing.

Right to restriction of processing:

You have the right to request that Solable limit the use of your personal data in the following circumstances:

  • You contest the accuracy of your personal data;
  • The processing is unlawful and you oppose their erasure and instead request the restriction of their use;
  • Solable no longer needs your personal data for the purposes of processing but you still need it for the establishment, exercise, or defense of legal rights;
  • You have objected to the processing while verification is being carried out on whether the legitimate grounds allow for the continuation of the processing.

Right not to be subject to an individual decision including profiling:

You have the right not to be subject to a decision based solely on automated processing, including profiling, producing legal effects concerning you or significantly affecting you.

Right to lodge a complaint with a supervisory authority:

If you believe that the processing of your personal data constitutes a violation of the applicable legislation, you have the option to file a complaint with the National Commission on Informatics and Liberty (CNIL).
